1. Service Agreement
WorksTrackr provides a suite of operational management tools for local government and municipal infrastructure. By using our services, you acknowledge that you are an authorized representative of your agency and possess the legal authority to bind said agency to these terms.
2. "As-Is" Provision & Liability
This platform is provided on an "as-is" and "as-available" basis. WorksTrackr, its owners, and its affiliates expressly disclaim all warranties, whether express, implied, or statutory. We shall not be held liable for any direct, indirect, incidental, or consequential damages—including but not limited to loss of revenue, operational downtime, or data corruption—arising from your use of the platform.
3. Agency Duty of Care & Record Keeping
Users bear full responsibility for the veracity and integrity of data input into the system. WorksTrackr is an auxiliary management tool and not a primary storage system of record. Agencies are strictly advised to print, verify, and maintain hard-copy backups of all critical documentation, grant-related reports, and FEMA-mandated logs to ensure regulatory compliance in the event of platform unavailability.
4. Indemnification
You agree to indemnify and hold WorksTrackr harmless from any claims, losses, or demands (including legal fees) made by any third party due to or arising out of your breach of these terms, your improper use of the platform, or your violation of any municipal or federal regulations.
5. Termination
We reserve the right to suspend or terminate access to your account at our sole discretion, without prior notice, for conduct that we believe violates these terms or is harmful to other users or the platform infrastructure.
